Judge will not throw out lawsuits filed by brother of JonBenet Ramsey

I’m October of 2016 Burke Ramsey filed a $150 million lawsuit against Dr. Werner Spitz who theorised that he had murdered his sister JonBenet on the CBS program The Case of: JonBenet Ramsey. A $750 million defamation lawsuit against CBS followed soon after. CBS and Spitz both asked for the cases to be thrown out by Judge David Groner has officially allowed both of the cases to go forward. The family lawyer, Lin Wood, has said “CBS’s public relations efforts downplay the significance of the ruling are borderline laughable.” She continues that “The heart and should of the defence strategy was clearly aimed at having these cases thrown out based on a finding that the comments were protected opinion.”

According to CBS’s lawyers the statements that Burke killed JonBenet “was never made in the series.”
The Case of: JonBenet Ramsey was a two-part miniseries released in September 2016 about the murder of six year old JonBenet in Boulder, Colorado on Christmas Day, 1996. The program came under major scrutiny for its vague assumptions and stating them as fact.

Wood believes that’s this victory looks good for JonBenet’s father John’s $350 million lawsuit against CBS which was filed a year after Burke’s lawsuit. “There is a pending motion to dismiss in John’s case against CBS based essentially on the same grounds as the motions filed in Burke’s case.” Wood adds.
